Terms of Service

1. Acceptance of Terms

By accessing or using Deal Scout 360 ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, you may not use the Service. These Terms constitute a legally binding agreement between you and Deal Scout 360.

2. Description of Service

Deal Scout 360 is an automated eBay monitoring platform that searches for listings matching your configured criteria and sends email alerts when matching items are found. The Service includes a web dashboard for configuring searches, managing alerts, and managing your subscription.

3. Account Registration and Security

3.1 Account Creation

You must create an account to use the Service. You agree to:

• Provide accurate, current, and complete information during registration
• Maintain and promptly update your account information
• Be at least 18 years old
• Maintain only one account per person
• Verify your email address before logging in for the first time

3.2 Account Security

You are responsible for maintaining the confidentiality of your password and for all activities under your account. Notify us immediately of any unauthorized access or security breach via our Contact page.

4. Subscription Plans and Billing

4.1 Subscription Tiers

We offer three subscription tiers: Basic (free), Pro, and Elite. Current pricing and features for each tier are available on our Pricing page. The Basic tier is free and does not require a payment method.

4.2 Payment Terms

• Paid subscriptions (Pro and Elite) are billed monthly in advance
• All fees are processed securely through Stripe
• We may update pricing with 30 days notice to existing subscribers
• Failed payments may result in service suspension or downgrade to the Basic tier
• By subscribing, you authorize automatic monthly charges to your payment method

4.3 Cancellation

You may cancel your paid subscription at any time from your Billing page. You will retain access to your paid tier until the end of the current billing period, then automatically move to the free Basic tier. There are no cancellation fees.

4.4 Lifetime Access Plans

We may offer limited-time "Lifetime Access" plans that grant permanent access to a specific subscription tier (typically Pro) for a one-time payment. By purchasing a Lifetime Access plan, you acknowledge and agree to the following terms:

• Service Duration: "Lifetime" means for the duration that Deal Scout 360 remains operational and available. It does not guarantee perpetual service.
• Service Discontinuation: If we discontinue the Service, shut down operations, or are acquired by another company that does not continue the Service, your Lifetime Access will terminate without refund or compensation.
• Feature Changes: We reserve the right to modify tier features, limits, or functionality with reasonable notice. Lifetime Access does not guarantee unchanged features forever.
• Fair Use: Lifetime Access is subject to our Acceptable Use Policy (Section 5). Abuse may result in account termination without refund.
• Non-Transferable: Lifetime Access is tied to your account and cannot be transferred, sold, or shared.
• No Refunds: Lifetime Access purchases are final sale and non-refundable after 30 days, except as required by law.
• Limited Availability: Lifetime Access offers are limited in quantity and duration. Once sold out or expired, they will not be available again.

Example: If you purchase Lifetime Pro Access and we later shut down the Service, you are not entitled to a refund of the one-time fee paid. Lifetime Access is a bet on the longevity of the Service, not a guarantee of its perpetual operation.

4.5 Plan Limits and Tier Adjustments

We reserve the right to modify the parameters, limits, and features of any subscription tier — including paid and Lifetime tiers — at any time, with or without prior notice, for any reason including but not limited to:

• Balancing server load, infrastructure capacity, or operational stability
• Responding to abuse, unusual usage patterns, or external service constraints (e.g., eBay API quotas)
• Restructuring tier offerings, pricing, or feature sets
• Any other business or technical reason at our sole discretion

Adjustable parameters include, but are not limited to: maximum number of active searches, scan frequency, daily alert limits, and access to specific features. Such changes apply to all users on the affected tier, including those with Lifetime Access plans (see Section 4.4).

Continued use of the Service following any tier parameter adjustment constitutes your acceptance of the modified limits. If a material downgrade is permanent and you hold a paid subscription, your sole remedy is to cancel your subscription and receive a prorated refund for the unused portion of your current billing period.

4.6 Google Play Billing (Android App)

If you purchase a subscription or Lifetime Access through the Deal Scout 360 Android app, your purchase is processed by Google LLC via Google Play Billing. The following additional terms apply:

• Subscriptions purchased via Google Play are billed and managed through your Google Play account. You may cancel at any time via the Google Play Store app under Subscriptions.
• Refunds for Google Play purchases are governed by Google Play's refund policy. We cannot process refunds for purchases made through Google Play — contact Google Play support directly.
• Subscription renewal, price changes, and billing are handled by Google. We receive purchase confirmations via webhook and activate or modify your account accordingly.
• If you have an active subscription on both web (Stripe) and Android (Google Play), your account will reflect the higher tier of the two.
• Lifetime Access purchased via Google Play grants the same permanent benefits as described in Section 4.4.

5. Acceptable Use Policy

5.1 Prohibited Activities

You agree not to:

• Use the Service for any illegal purpose or in violation of any applicable laws
• Attempt to circumvent usage limits, rate limits, or tier restrictions
• Reverse engineer, decompile, or attempt to extract source code
• Share account credentials with others
• Create multiple accounts to evade plan limits
• Resell or redistribute the Service without written permission
• Use the Service to harass or harm other users

5.2 Fair Use

Your subscription tier determines your search count, scan frequency, and daily alert limits. Use that creates undue burden on our systems may result in throttling or account suspension.

6. Intellectual Property

6.1 Our Property

The Service, including all content, features, functionality, software, and design, is owned by Deal Scout 360 and protected by copyright, trademark, and other intellectual property laws.

6.2 Your Content

You retain ownership of your search configurations and account data. By using the Service, you grant us a limited license to use your configuration data to operate and improve the Service.

7. Third-Party Services

The Service integrates with eBay's Browse API, Etsy's API, Stripe for web payments, Google Play Billing for Android app purchases, and RevenueCat for in-app purchase management. We are not responsible for the availability, accuracy, or policies of these third-party services. Your purchases on eBay or Etsy are subject to those platforms' own Terms of Service and are entirely between you and the seller.

8. Service Availability

We strive for high availability but do not guarantee uninterrupted service. We may:

• Perform scheduled maintenance (announced in advance where possible)
• Experience unexpected downtime due to technical issues
• Modify or discontinue features with reasonable notice
• Update these Terms (you will be notified of material changes)

9. Disclaimers and Limitation of Liability

9.1 Service Provided "As Is"

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DO NOT GUARANTEE THE ACCURACY, COMPLETENESS, OR TIMELINESS OF EBAY LISTING DATA OR ALERTS. DEALS MAY NO LONGER BE AVAILABLE BY THE TIME AN ALERT IS RECEIVED.

9.2 Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, DEAL SCOUT 360 SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING MISSED DEALS, LOST PROFITS, OR DATA LOSS. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE PAST 12 MONTHS.

10. Indemnification

You agree to indemnify and hold harmless Deal Scout 360 and its operators from any claims, damages, losses, or expenses arising from your use of the Service, violation of these Terms, or infringement of any rights of another party.

11. Termination

We may suspend or terminate your account immediately if you:

• Violate these Terms or our Acceptable Use Policy
• Fail to pay required subscription fees
• Engage in fraudulent or harmful activities

Upon termination, your right to use the Service ceases immediately. You may request a copy of your account data within 30 days of termination.

12. Dispute Resolution

12.1 Informal Resolution

Before filing any formal claim, please contact us through the Contact page to attempt informal resolution. Most disputes can be resolved quickly and amicably.

12.2 Arbitration

Any dispute arising from these Terms or the Service that cannot be resolved informally shall be resolved through binding arbitration under the rules of the American Arbitration Association, rather than in court. You waive your right to a jury trial and class action participation.

12.3 Governing Law

These Terms are governed by the laws of the State of Arkansas, United States, without regard to conflict of law principles.

13. General Provisions

• Entire Agreement: These Terms constitute the entire agreement between you and Deal Scout 360
• Severability: If any provision is found unenforceable, the remaining provisions stay in effect
• No Waiver: Our failure to enforce any right does not constitute a waiver of that right
• Assignment: You may not assign these Terms; we may assign them in connection with a business transfer
• Force Majeure: We are not liable for failures caused by circumstances beyond our reasonable control
